Thursday afternoon, the Supreme Court blocked President Biden’s vaccine and testing requirement aimed at large businesses.
This ruling by the Supreme Court actually has nothing to do with healthcare or the pandemic – it has to do with Liberty.
“Although Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly. Requiring the vaccination of 84 million Americans, selected simply because they work for employers with more than 100 employees, certainly falls in the latter category,” an unsigned opinion from one of the justices said.
I am overjoyed that the Supreme Court got this one right.
Business owners should make their own decisions without government mandates.
Businesses don’t want their employees to miss work because they are sick. They don’t want their public work spaces to become known as super spreader locations. Companies, not the federal government, must be allowed to choose what’s best for their operations. If government engagement was necessary at some point, that should be coming from the state or local levels – NOT an overreaching federal agency.
The market always does better than the government, and healthcare is no exception. One look at the care and treatment our veterans receive from the VA says enough. Government mandated healthcare options have resulted in people dying in waiting rooms or ridiculous wait times for basic services. This is not helpful.
If the government wanted to actually help encourage people to get vaccinated, they would let the free market take centerstage.
To start, the government could remove provisions introduced by the Affordable Care Act that prevent insurance companies from making their own coverage decisions. The insurance companies could choose if they wanted to insure or raise rates on the unvaccinated, and they could do it based on actuarial tables rather than arbitrary politics.
The public shouldn’t be expected to pay for public health care based on private decisions. If an insurance company wants to continue to charge vaccinated and unvaccinated individuals the same rate, they should have that ability as a private business. If they want to charge different rates, that should be an option too.
What shouldn’t be an option? The government’s ability to force one person’s values on millions of people with no free market solution. It’s time these abusive actions come to an end. Today’s SCOTUS ruling should be just the start.
